The Penang Tunnel project was awarded thru a Request for Proposal (RFP or “Permintaan untuk Cadangan”) exercise.
Not via open tender.
RFP is not open tender. There is a world of difference between RFP and open tender.
There is no room for subjective decision for open tender. The winner is always the qualified supplier giving the lowest price.
Under RFP, selection is subjective as it is possible for proposals which are not the lowest bidder or the best-qualified company to be selected. Each proposed solution can be vastly different even for the same project.
After evaluating the 4 proposals received for the Penang Tunnel project RFP, the evaluation panel submitted its evaluation results which comprise the pros and cons of each proposal received to the Penang state EXCO.
Final decision to select winning proposal was made by the Penang state EXCO chaired by Guan Eng then.
1. Ask DAP if it a RFP or was it an open tender? Ask him to show you the “open tender” notice for the Penang Tunnel Company.
2. Ask DAP if the final decision was made by the evaluation committee or the Penang EXCO.
